Summary of the law
Purpose and scope
- Details the Criminal Procedure Law on bringing cases, investigation, detention, trial, objections to judgments and their enforcement.
Key rules, rights and obligations
- Parties' requests during investigation are made in writing, and the investigator must decide them within five days, or within twenty-four hours if urgent (Article 49).
- The detention facility must allow a person held in pre-trial detention to challenge the detention order and help them reach the competent authority (Article 80).
- A prisoner or detainee may complain orally to the prison director, who records it and refers it to the competent prosecution member (Article 26).
Violations, penalties and common problems
- Common problems: missing the objection deadline, after which a judgment not subject to review becomes final (Article 141).
- Objecting orally or without a complete memorandum: an objection is accepted only by a memorandum filed with the issuing court within the deadline (Article 142).
- If a person with a suspended sentence commits an offence within the set period, the suspension may be lifted and the first sentence enforced (Article 153).
Procedures and key deadlines
- The case record must note that the parties were told of their right to object and its deadline (Article 139).
- More than one objection memorandum may be filed while the deadline is running (Article 142).
- Withdrawing an objection does not shorten the deadline or forfeit the right while the deadline is running (Article 140).
