In brief
Governs how a juvenile (aged seven to under eighteen) is arrested, investigated and tried, the measures that replace punishment, and placement in an observation home instead of prison.
Summary of the law
Key points
- No criminal liability under the age of seven at the time of the act (Article 2).
- A juvenile is held for investigation only if the prosecution sees it necessary, only in the home, and by a reasoned order (Article 7).
- Under fifteen, only measures apply, such as reprimand, handing over to a guardian, or placement in a social institution for up to a year if aged twelve or more (Article 15).
From fifteen
- Prescribed penalties apply except prison: placement in the home for up to half the maximum penalty (Article 15).
- On turning eighteen before the end of placement, the rest is served in prison unless the court decides otherwise (Article 17).
- Conditional release is possible after a quarter of the term (Article 20).
Tip for parents
- Ask to attend the investigation, make sure your child is held in the observation home, and involve a lawyer early to seek an alternative measure.
