Summary
A beneficiary asked for her brother to be appointed administrator of a waqf after the previous one was removed, as the beneficiaries could not agree. The judge established the waqf's assets and beneficiaries by deeds and testimony, appointed the candidate as fit, set his fee at a tenth of the income, and the Court of Appeal upheld it.
Principle
When beneficiaries disagree, the judge appoints the fittest administrator after verifying the waqf's assets and beneficiaries, and sets the administrator's fee.

These summaries are general information to help you understand how courts approach issues. The judgments predate later laws such as the Civil Transactions, Evidence and Personal Status laws; every case turns on its facts and a past judgment is no substitute for a lawyer's advice.
Library content is simplified general information for awareness only. It is not legal advice and does not replace the official text. Laws change: always check the official source and consult a lawyer before acting. Library data last reviewed: .
